The SA Constitution – Law Assignment Help

Assignment Task

THE SA CONSTITUTION (THE BILL OF RIGHTS) IN THE LIGHT OF A VISION OF A GOOD SOCIETY.
A healthy society vision is essentially a spiritual vision. It illuminates the path to a brighter future for society and ensures peace and harmony. A moral vision usually refers to what is important and should be meaningful; it is focused on what is valuable and worthy of consideration and attention. The Bill of rights seeks to transform society as a whole, not just individuals and that is what I will discuss in this essay.
We now live in a world where everyone dreams about what can only help them, which is why I believe it is critical that a moral vision be developed as soon as possible. A positive moral derived from the Bill will not only make the future a better place for everyone, but it will also make the present a better place for everyone. A good moral vision will not only create a better future for the society but it will also bring equality and peace amongst our people as what the Bill of rights also wants to promote. The bill of rights specifically promotes peace and equality to the citizens and also makes us aware of to which extent can our freedom go. They act as a cornerstone in our country and affirms the democratic values of human dignity and freedom. However, every right comes with a responsibility and it is up to us the citizens that we live up to those responsibilities.

The Bill of rights is located in chapter 2 of the Constitution, they are meant to be respected and this includes also the state. This is a human rights charter that protects the civil, political and socio-economic rights of all people in South Africa. The rights in the Bill apply to all law, including the precedent-based law, and tie all parts of the public authority, including the public chief, Parliament, the legal executive, common governments and metropolitan committees. A few arrangements, for example, those restricting out of line segregation, likewise apply to the activities of private people. The South African Bill of rights originated from a long struggle against racism and injustice. The same year that the South African apartheid government came into power in 1948, the United Nations adopted the Universal Declaration of human rights, which is now the international standard for human rights. South Africa was one of the eight countries that refused to sign this fundamental human rights instrument because the government was already preparing for a program of racism that systemically violates all rights recognised in this declaration.(South African History Book, 1955. In the appearence of the insubordination Lobby (Defiance Campaign), a multi-racial aloof obstruction drive that dispatched in 1952 to voice issue with politically-sanctioned racial segregation, a recorded precursor to our Bill of Rights appeared. The opportunity contract, communicating the opportunity requests gathered from individuals across South Africa, was received in 1955 at the Congress of Individuals in Kliptown. The South African legislature of the time pronounced the Opportunity Sanction to be backstabbing and prosecuted 156 individuals in December 1956, blaming them at the injustice Preliminary for looking to oust the state by embracing this sanction. The contract turned into an amazing power in uniting individuals of all races in a typical battle for the destruction of politically-sanctioned racial segregation and the foundation of a non-racial majority rule state. The contract was received by the Assembled Vote based Front (UDF) during the 1980s and its ‘opportunity requests’ highlighted vigorously in basic liberties crusades all through this decade.

South Africa’s first bill of rights was contained in Section 3 of the momentary Constitution of 1993, which was drawn up as a feature of the exchanges to end politically-sanctioned racial segregation. This “break Bill of Rights”, which came into power on 27 April 1994, was generally restricted to common and political rights. The current Bill of Rights, which supplanted it on 4 February 1997 , held these rights and added various new certain financial, social and social rights. (Brice Dickson, 1999. Accessed 15 May 2021). As a citizen the bill of rights the Bill of rights has an effect on me daily. We use examples of these rights in regularly like when we get up every day and pick what we are going to do, when we practice our religions, and when we assemble in peace every day. Most of these rights are listed in the Bill of Rights, and we are able to exercise them every day.

The Bill of rights contains several rights such as the right to freedom of speech, religion, human dignity, etc. However, how do these rights create a light to a vision of a good society? According to chapter, Section 9 of the Constitution, everyone has a right to equality. This right aims to create a vision of a good society where everyone must be treated and feel equal. It is against the act of discrimination so it creates light to a better and peaceful society, where everyone will feel free to do anything without being judged based on his or her status. It also wants to correct the discrimination of gender and inequality as that is the saddest situation at hand in South Africa. Bert Oliver, a South African author stated that South Africa is still in denial about the unsuitable inequality characteristics of this society and that includes the killing and abuse of women and same sex couples. This needs to change because it promotes inequality and goes against the equality right.
Furthermore, the right to human dignity which is stated in Section 10 of the Constitution aims to promote respect in our societies. Dignity is the first-rate of being honourable, noble, exceptional or worthy. With a human considered as the most supreme dwelling creature, dignity, in its attractive sense, is higher referred to as human dignity. It is the conceptual foundation for the formula and execution of human rights and is neither granted with the aid of the society nor can it be legitimately granted via the society. An integral implication of human dignity is that each human being should be viewed as a very precious member of the neighbourhood with a uniquely free expression of their proper to life, built-in bodily attributes and their non-secular nature.
Education, what can I say? I feel like this is the most important right when it comes to building good skills for a society. It is explained in Section 29 of the Bill and is the most useful right because a society can never be good without knowledge. A good society needs people that are educated, that have skills to improve the living of their society so that is where education is needed. It is said that education is the key to success so what can a society be without this key that will open a bright future and doors for its society? The idea of education for the Great Society is an endeavour to address the emergency of instructive vision. This isn’t the main endeavour; numerous others have attempted previously. Nonetheless, looking across Left mediations it is conceivable to see pessimism, where a positive vision of instruction has gotten subordinate to a dread of the foe. As the Privilege progressed its plan, so the Left’s vision of instruction additionally appeared to thin, frequently withdrawing into a bunch of apprehensions about inconsistent results because of the very achievements of neo-radicalism.
To sum up everything I have stated, I believe that the Bill of rights create light to a vision of a good society because every right aims to promote peace and equality in the society. The Bill of rights also plays an important role in building a good society so that is why we have to honour and respect every right that is stated in the Bill.
